The instructor wants to have the library create a scanned PDF of material not available through OMNI for research purposes. Is this allowed?

Answer

 

  • One of the safeguards of Fair Dealing is for the material to be within the collection of the instructor or library. As the material is outside of the library’s collection, permission must be cleared to create a reproduction for this purpose.
  • If the material is available through OMNI Inter-library Loan (ILL), and also meets the limits of York’s Fair Dealing Guidelines, it may still be possible to have a copy created for the instructor. Instructors should make OMNI Interlibrary Loan requests themselves.
